Your comments in category #2 are a great starting point, but for complete, accurate information readers should definitely consult an attorney in their home state because the law varies. One of the main considerations is whether or not you live in a community property state. This statement, "if your spouse has financial difficulties (for any reason) and is forced to file bankruptcy or their credit becomes derogatory, you and your spouse will have your credit in reserve to survive on," needs exploration and research beyond the parameters of your site/post. If debts are community in nature -- and that will depend not only upon who actually incurred the debt, but the law of the state in question and the characterization of the property obtained via the debt as well as the source of the funds used to pay down the debt, one spouse filing a bk will impact the other spouse and his/her credit standing. The fact that only one spouse is actually a party to the bk proceeding does NOT mean that the other spouse is insulated from the fallout. Not by a long shot. Moreover, having joint credit no longer means that one does not have one's own credit history, profile and ability to borrow. That used to be the case but the laws have evolved. I am not here to provide legal advice and nothing I have written here may be construed as legal advice or as having created an attorney-client relationship with any person or entity. In any event . . . THANKS for participating in this week's Carnival of Family Life hosted by Karen at Write from Karen. The Carnival will go live on Monday, January 14, 2008, and I invite you and all of your readers to peruse all of the excellent submissions this week! Interested in hosting? Stop by Colloquium, check out the schedule and drop me a note stating which week works for you! |
